Kushtet e Shërbimit të Replyge

Këto Kushte Shërbimi ("Kushtet") rregullojnë përdorimin tuaj të Replyge, një asistent i kujdesit ndaj klientit me AI për llogaritë Instagram Business dhe numrat WhatsApp Business. Duke hapur një llogari Replyge, ose duke lidhur një llogari Instagram Business ose numër WhatsApp Business me Replyge, ju pajtoheni me këto Kushte. Nëse nuk pajtoheni, mos e përdorni shërbimin.

1. Kush jemi

"Replyge", "ne" dhe "yni" i referohen QuantumTechX SH.P.K., shoqëri me përgjegjësi të kufizuar e regjistruar në Kosovë me numër identifikues biznesi 812177302, me seli në Shote Galica, Pn, Vushtrri, Kosovë. Kontakti: support@replyge.com.

2. Çfarë bën Replyge

Replyge lidhet me llogarinë tuaj Instagram Business dhe/ose numrin tuaj WhatsApp Business përmes API-ve zyrtare të Metës (Instagram Graph API dhe WhatsApp Business Platform). Kur një klient i shkruan biznesit tuaj në Instagram ose WhatsApp, Replyge u përgjigjet mesazheve duke përdorur një model AI (Anthropic Claude) dhe ia dërgon përgjigjen klientit përmes llogarisë/numrit tuaj, brenda dritares 24-orëshe të kujdesit ndaj klientit të Metës. Kontrolli mbetet plotësisht i juaji: mund t'i ndalni përgjigjet e AI-së, ta merrni bisedën në dorë vetë, ta shkëputni Instagramin/WhatsApp-in ose ta fshini llogarinë në çdo kohë.

3. Llogaria juaj

• Duhet të jepni të dhëna të sakta regjistrimi dhe një email që punon.
• Jeni përgjegjës për ruajtjen e sigurt të fjalëkalimit tuaj. Ne nuk e ruajmë si tekst të thjeshtë (fjalëkalimet hash-ohen me Argon2id).
• Duhet të jeni së paku 18 vjeç, ose në moshën ligjore të zotësisë kontraktuese në juridiksionin tuaj.
• Mund të lidhni vetëm llogari Instagram ose numra WhatsApp Business që i zotëroni ose që jeni i autorizuar t'i menaxhoni në emër të mbajtësit të llogarisë/numrit.
• Një llogari Replyge për biznes. Ndarja e kredencialeve mes bizneseve të palidhura nuk lejohet.

4. Përdorimi i pranueshëm

Pajtoheni të MOS e përdorni Replyge për të:

• Dërguar mesazhe që shkelin Kushtet e Platformës të Metës, Udhëzimet e Komunitetit të Instagramit, Politikën e Biznesit të WhatsApp, apo Politikat e Zhvilluesve të Metës.
• Dërguar mesazhe promovuese të pakërkuara, spam, ose marketing të palidhur jashtë dritares së lejuar të kujdesit ndaj klientit — p.sh. pa një token të vlefshëm One-Time-Notification në Instagram, ose pa një shabllon (template) mesazhi të aprovuar nga Meta në WhatsApp.
• Imituar një biznes, person ose markë tjetër.
• Shitur, promovuar ose shpërndarë mallra të paligjshme, përmbajtje për të rritur, armë, drogë të paligjshme, apo çdo përmbajtje të ndaluar nga Meta ose nga ligji i Kosovës.
• Bërë inxhinieri të kundërt të shërbimit Replyge, nxjerrë të dhëna prej tij, apo tentuar të anashkaloni kufijtë e shpejtësisë ose kontrollet e sigurisë.
• Ngarkuar API-t e Metës në mënyrë të automatizuar përmes Replyge për qëllime të tjera nga kujdesi legjitim ndaj klientit.
• Ngacmuar, shpifur ose dëmtuar ndonjë individ apo grup.

Shkelja e cilësdo prej tyre është bazë për pezullim të menjëhershëm të llogarisë suaj Replyge, dhe ne mund ta raportojmë shkeljen te Meta. Shkeljet e përsëritura ose të rënda mund të bëjnë që Meta ta kufizojë në mënyrë të pavarur llogarinë tuaj Instagram Business, gjë që është jashtë kontrollit tonë.

5. Të dhënat e klientëve tuaj

Kur Replyge trajton mesazhet e klientëve tuaj në Instagram ose WhatsApp, ju mbeteni kontrollues i të dhënave për ato të dhëna klientësh dhe Replyge vepron si përpunues i të dhënave për ju. Jeni përgjegjës t'u tregoni klientëve tuaj (p.sh. te bio-ja juaj në Instagram, faqja e biznesit, ose përgjigja e parë e AI-së) se përdoren përgjigje të gjeneruara me AI. Shihni Politikën e Privatësisë për mënyrën si i trajtojmë të dhënat në emrin tuaj.

6. Çmimet dhe faturimi

Replyge aktualisht operon me një nivel falas (deri në një kuotë mujore mesazhesh) dhe nivele me pagesë për kuota më të larta. Niveli aktual duket brenda panelit tuaj Replyge te Cilësimet → Plani. Mund t'i ndryshojmë çmimet me së paku 30 ditë njoftim me email; mund të anuloni para se çmimi i ri të hyjë në fuqi.

Nëse e tejkaloni kuotën mujore, përgjigjet e AI-së ndalen deri në periudhën e ardhshme të faturimit ose derisa të përmirësoni planin. Kurrë nuk faturojmë tejkalime në heshtje.

7. Disponueshmëria e shërbimit

Synojmë 99% kohë funksionimi mujore, por Replyge ofrohet "siç është" pa garanci disponueshmërie. Mirëmbajtja e planifikuar dhe ndërprerjet e vetë API-ve të Metës përjashtohen nga çdo llogaritje disponueshmërie. Nuk jemi përgjegjës për mesazhe të humbura apo porosi të humbura të shkaktuara nga kufijtë e shpejtësisë së API-ve të Metës, çvlerësimi i tokenit të qasjes nga Meta, ndërprerjet e Instagramit ose WhatsApp, apo nga zgjedhja juaj për ta shkëputur Replyge.

8. Prona intelektuale

• Softueri, marka dhe emri "Replyge" janë pronë e QuantumTechX SH.P.K.
• Ju ruani të gjitha të drejtat mbi katalogun tuaj të produkteve, përmbajtjen e biznesit dhe të dhënat e klientëve.
• Duke lidhur llogarinë tuaj Instagram ose numrin tuaj WhatsApp Business, na jepni një licencë të kufizuar për të lexuar mesazhet tuaja dhe për të përgjigjur në emrin tuaj, vetëm për të ofruar shërbimin. Kjo licencë përfundon menjëherë kur shkëputeni ose e fshini llogarinë.

9. Përfundimi

• Nga ju: në çdo kohë, duke shtypur "Fshi llogarinë" te Cilësimet ose duke shkruar te adresa më poshtë. Shkëputja e Instagramit ose WhatsApp-it e mban llogarinë tuaj Replyge, por e ndal integrimin me AI në atë kanal.
• Nga ne: mund të pezullojmë ose mbyllim llogari që shkelin këto Kushte, që Meta i ka ndaluar, ose që kanë qenë joaktive 12+ muaj. Kur është e arsyeshme, ju paralajmërojmë më parë.
• Me përfundimin, i fshijmë të dhënat tuaja brenda 30 ditësh, përveç regjistrimeve që jemi të detyruar t'i mbajmë me ligj (p.sh. regjistrime tatimore).

10. Përgjegjësia

Në masën maksimale të lejuar me ligj, përgjegjësia e përgjithshme e Replyge ndaj jush sipas këtyre Kushteve kufizohet në shumën që na keni paguar në 12 muajt para ngjarjes që shkakton kërkesën, ose 100 EUR, cilado qoftë më e madhe. Nuk jemi përgjegjës për dëme indirekte, pasuese ose ndëshkuese, përfshirë fitime të humbura ose klientë të humbur.

11. Ndryshimet e këtyre Kushteve

Mund t'i përditësojmë këto Kushte herë pas here. Ndryshimet thelbësore u komunikohen llogarive aktive me email së paku 14 ditë para se të hyjnë në fuqi. Vazhdimi i përdorimit të Replyge pas ndryshimit do të thotë se i pranoni Kushtet e reja.

12. Ligji i zbatueshëm

Këto Kushte rregullohen nga ligjet e Republikës së Kosovës. Çdo mosmarrëveshje që nuk mund të zgjidhet me negociata i nënshtrohet juridiksionit ekskluziv të gjykatave të Prishtinës, Kosovë. Për konsumatorët e vendosur në BE, zbatohet gjithashtu legjislacioni i detyrueshëm për mbrojtjen e konsumatorit në vendin tuaj të banimit.

Replyge Terms of Service

These Terms of Service ("Terms") govern your use of Replyge, an AI-powered customer-service assistant for Instagram Business accounts and WhatsApp Business numbers. By creating a Replyge account, or connecting an Instagram Business account or WhatsApp Business number to Replyge, you agree to these Terms. If you do not agree, do not use the service.

1. Who we are

"Replyge", "we", "us" and "our" refer to QuantumTechX SH.P.K., a limited liability company registered in Kosovo under business identification number 812177302, registered office at Shote Galica, Pn, Vushtrri, Kosovo. Contact: support@replyge.com.

2. What Replyge does

Replyge connects to your Instagram Business account and/or WhatsApp Business number through Meta's official APIs (the Instagram Graph API and the WhatsApp Business Platform). When a customer messages your business on Instagram or WhatsApp, Replyge replies to the message using an AI model (Anthropic Claude) and sends it back to the customer through your account/number, within Meta's 24-hour customer service window. You retain full control: you can pause AI replies, take over the conversation manually, disconnect Instagram/WhatsApp, or delete your account at any time.

3. Your account

• You must provide accurate signup information and a working email.
• You are responsible for keeping your password secure. We do not store it in plain text (passwords are hashed with Argon2id).
• You must be at least 18 years old, or the legal age of contractual capacity in your jurisdiction.
• You may only connect Instagram accounts or WhatsApp Business numbers that you own or are authorised to manage on behalf of the account/number holder.
• One Replyge account per business. Sharing credentials between unrelated businesses is not permitted.

4. Acceptable use

You agree NOT to use Replyge to:

• Send messages that violate Meta's Platform Terms, Instagram's Community Guidelines, WhatsApp's Business Policy, or the Meta Developer Policies.
• Send unsolicited promotional messages, spam, or unrelated marketing outside the allowed customer-service window — e.g. without a valid One-Time-Notification token on Instagram, or without a Meta-approved message template on WhatsApp.
• Impersonate another business, person, or brand.
• Sell, promote, or distribute illegal goods, adult content, weapons, illicit drugs, or any content prohibited by Meta or by Kosovo law.
• Reverse-engineer the Replyge service, scrape data from it, or attempt to bypass rate limits or security controls.
• Run automated load against Meta's APIs through Replyge for purposes other than legitimate customer service.
• Use Replyge to harass, defame, or harm any individual or group.

Violating any of these is grounds for immediate suspension of your Replyge account, and we may report the violation to Meta. Repeated or severe violations may also result in Meta independently restricting your Instagram Business account, which is outside our control.

5. Your customers' data

When Replyge handles your customers' messages on Instagram or WhatsApp, you remain the data controller for that customer data and Replyge acts as your data processor. You are responsible for telling your customers (e.g. in your Instagram bio, store page, or first AI reply) that AI-powered replies are used. See our Privacy Policy for how we handle data on your behalf.

6. Pricing and billing

Replyge currently operates with a free tier (up to a monthly message quota) and paid tiers for higher quotas. The current tier is visible inside your Replyge dashboard under Settings → Plan. We may change pricing with at least 30 days' notice by email; you may cancel before the new pricing takes effect.

If you exceed your monthly quota, AI replies pause until the next billing period or until you upgrade. We never silently charge for overages.

7. Service availability

We aim for 99% monthly uptime but Replyge is provided "as is" without uptime guarantees. Planned maintenance and Meta's own API outages are excluded from any availability calculation. We are not liable for missed messages or lost orders caused by Meta API rate limits, Meta access-token invalidation, Instagram or WhatsApp outages, or your own choice to disconnect Replyge.

8. Intellectual property

• Replyge software, branding, and the "Replyge" name are owned by QuantumTechX SH.P.K.
• You retain all rights to your product catalogue, shop content, and customer data.
• By connecting your Instagram account or WhatsApp Business number, you grant us a limited licence to read your messages and reply on your behalf, solely to provide the service. This licence ends immediately when you disconnect or delete your account.

9. Termination

• By you: at any time, by clicking Delete account in Settings or by emailing the address below. Disconnecting Instagram or WhatsApp alone keeps your Replyge account but stops the AI integration on that channel.
• By us: we may suspend or terminate accounts that violate these Terms, that Meta has banned, or that have been inactive for 12+ months. Where reasonable, we will warn you first.
• On termination, we delete your data within 30 days, except records we are required to keep by law (e.g. tax records).

10. Liability

To the maximum extent permitted by law, Replyge's total liability to you under these Terms is capped at the amount you paid us in the 12 months preceding the event giving rise to the claim, or 100 EUR, whichever is greater. We are not liable for indirect, consequential, or punitive damages, including lost profits or lost customers.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated to active accounts by email at least 14 days before they take effect. Continued use of Replyge after the change means you accept the new Terms.

12. Governing law

These Terms are governed by the laws of the Republic of Kosovo. Any dispute that cannot be resolved by negotiation will be subject to the exclusive jurisdiction of the courts of Pristina, Kosovo. For consumers located in the EU, mandatory consumer-protection law in your country of residence also applies.
